What to do After a Dog Attack

1. Get appropriate medical care quickly
Dog bites may require prompt, specialized medical care. Frequently, an animal bite can cause extensive damage to skin, nerves and other parts of the body. Even a “minor” bite with minimal bleeding may damage layers of skin and effect nerves close to the surface. In addition, an open wound may provide access for a serious infection that will not be obvious for days. Severe attacks may result in extensive lacerations, which require multiple surgeries and procedures.

2. Photograph the injuries
Fortunately, skilled plastic surgeons and the passage of time may heal even the most extensive injuries. If it is necessary for you to prove the severity of your injuries, “a picture is worth a thousand words.” Take photographs early and often to document your injuries and treatment.

3. Contact the government agency responsible for human and pet safety
The County of San Diego, Department of Animal Services has the capability to investigate dog attacks and take appropriate action. This includes taking temporary custody of an attacking dog and making recommendations to prevent further injury. The Department also provides the opportunity for hearings before professional, experienced officers to determine the best way to protect people and pets. 4. Report your injuries to insurance carriers
Frequently, the dog owner’s fire/homeowner insurance carrier will cover medical bills and other costs related to a dog attack. Your health insurance carrier may require you to advise them your injuries were caused by a “third party”. Some insurance companies require prompt reporting of claims as part of their policies.

5. Contact an experienced attorney before agreeing to or signing anything
Discuss your rights and responsibilities with an experienced attorney before you agree to or sign anything. The insurance carrier for the dog owner (which is not required to treat you fairly) may pressure you to make important decisions before you get legal advice. Some insurance companies routinely ask injured people to give them unlimited access to private medical and employment records. Do NOT release your private records, sign anything, give a statement or make decisions until you get advice from an attorney with experience in this area.
