Prosecutors with the District Attorney’s Office in Anaheim argue that the defendant knew the risks of drinking and driving, but chose to get behind the wheel anyway. After being sent to the hospital for his injuries, the defendant measured at a .18 blood alcohol level, far above the .08 level required by the law.
